ESMA issues a series of question and answer guidance pieces on various topics. The fundamental aim of these is to ensure consistency in interpretation of related matters across the EU and to assist market participants as well as local national competent authorities.
On 17th December 2021 ESMA issued updated Q&As on the application of the AIFMD, Securities settlement in the EU, UCITS and SFTR data reporting. The update relating to the AIFMD concerns investing in crypto assets and notes that the AIFMD will apply to investments in this asset class, noting the specific risks posed by this alternative asset class. Previous updates to various Q&A documents had also been made in November 2021.
