We act in contentious and non-contentious construction matters on behalf of all parties in construction projects including employers, main contractors, sub-contractors and professional advisors such as Architects, Engineers and Designers. The firm has extensive experience acting in arbitrations, mediations and conciliations, and High Court litigation proceedings arising from construction disputes.

 

The firm also advises on Letters of Appointment for all members of the design team and advises on Collateral Warranties which may be required on certain projects.  In addition to providing construction law advice on design liability, contract interpretation and loss and expense claims, we also provide project finance advice in connection with the funding of small to medium sized construction projects.

  • Advising a Contractor on a Design and Building Contract for an iconic Dublin Development;

 

  • Advising a Contractor in a multi-party construction mediation process in respect of a well-known Hotel;

 

  • Advising a Sub-Contractor on a claim for Extension of Time, Variations and Delay in Mediation proceedings;

 

  • Advising a Sub-Contractor in an Arbitration on a claim for Variations on an award-winning Dublin office block development;

 

  • Advising a Developer in High Court litigation in respect of Performance Bonds.

Founding Partner

Kevin Lynch is a founding partner of Clerkin Lynch LLP. He trained and qualified as a solicitor in a leading Dublin law firm, where he worked for 7 years prior to establishing Clerkin Lynch LLP. Kevin has particular expertise in the areas of commercial law, commercial litigation and contentious and non-contentious construction law.
